PROMOTIONAL COMPETITION TERMS AND CONDITIONS  


“The SOOQ Monthly Business Boost”
 

1. Introduction       
1.1 These Terms and Conditions ("Terms") govern The SOOQ Monthly Business Boost Competition ("the    Competition") organized by The SOOQ (Pty) Ltd in collaboration with Thrive Foundation NPC ("the Organisers").

1.2 By participating in the Competition, all entrants and participants agree to be bound by these Terms, which will be interpreted and applied in accordance with the laws of the Republic of South Africa, including the Consumer Protection Act, 68 of 2008 (CPA), and the Protection of Personal Information Act, 4 of 2013 (POPIA).      
1.3 The Organisers reserve the right to amend or update these Terms at any time without prior notice, and any changes will be published on the Organisers official website or social media platforms.

2. Eligibility and Entry      
2.1 The Competition is open to all South African citizens and permanent residents who are 18 years or older.      
2.2 Any member of the public may nominate a business by tagging them in the comments section of the Organisers’ official “Monthly Boost” competition posts on social media.
2.3 To be eligible for the prize, nominated businesses must:    
a) Range at least one product or service with The SOOQ; and   
b) Submit a motivational entry, which may include a video and/or images with accompanying text, explaining why they deserve to be boosted.      
2.4 Voting is open to all followers of The SOOQ and Thrive Foundation on the designated monthly vote poll.

2.5 Employees, directors, or immediate family members of The SOOQ (Pty) Ltd, Thrive Foundation NPC, or any affiliated companies or agents may not enter or participate in the Competition.

 

3. Competition Period and Prize
3.1 The Competition will run on a monthly basis until terminated solely at the discretion of the Organisers, who reserve the right to end the Competition at any time without prior notice.     
3.2 Each month, one winning business will be selected based on public votes and the strength of their motivational submission, as outlined in Clause 4.  
3.3 The winning business will receive:     
a) A R5,000 cash boost sponsored by The SOOQ; and   
b) An additional "Double Boost" should an external contributor choose to sponsor a matching cash contribution (subject to availability).

c)Any additional “Double Boost” contribution pledged by an external contributor towards the Monthly Business Boost Competition shall be subject to a non-refundable administration fee of 2% (two percent) of the total pledged amount. This fee shall be deducted prior to the disbursement of the contribution to the winning business and shall be utilised to cover administrative, verification, and compliance processing costs incurred by the Organisers. By making a pledge, the contributor expressly agrees to this deduction and acknowledges that the remaining balance will constitute the final contribution disbursed to the beneficiary.      
3.4 The Organisers reserve the right to verify the eligibility and authenticity of all entries and supporting materials submitted. In the case of external contributors offering to provide a Double Boost or any form of donation, the Organisers will conduct verification in accordance with applicable laws, including the collection and processing of all required information, pledge forms, and FICA declarations. Such documentation must be completed to the satisfaction of the Organisers in order for any Section 18A tax-deductible certificate to be issued.

 

4. Winner Selection and Announcement         
4.1 The winner will be determined based on a combination of:  
a) The highest number of verified public votes received in the official monthly vote poll; and
b) The strength and impact of the motivational submission (including creativity, authenticity, and alignment with the values of The SOOQ and Thrive Foundation), as assessed by the Organisers.

4.2 In the event of a tie or at the Organisers’ discretion, the final decision may weigh motivational submissions more heavily to ensure that the prize benefits a business that demonstrates genuine passion, community impact, or potential for growth.      
4.3 The Organisers’ decision is final and binding, and no correspondence will be entered into.

4.4 Winners will be announced publicly on The SOOQ and Thrive Foundation’s social media platforms and contacted directly via their provided contact information.       

5. Use of Personal Information (POPIA Compliance)          
5.1 By entering the Competition and/or by voting, participants explicitly consent to the Organisers collecting, storing, and processing their personal information, including but not limited to names, social media handles, business profiles, and images/videos for the following purposes:     
a) Administering and conducting the Competition;        
b) Announcing and promoting winners;    
c) Marketing and promotional communications related to The SOOQ, Thrive Foundation, and future competitions or initiatives; and     
d) Publication on public platforms including, but not limited to, social media, websites, and email newsletters.
5.2 Personal information will be handled in accordance with applicable data protection laws and will not be sold or unlawfully shared with any third party.      
5.3 Participants may withdraw their consent at any time by contacting the Organisers at [insert email address], provided that such withdrawal does not affect the lawfulness of any prior processing.

6. General    
6.1 The Organisers reserve the right to disqualify any entry that is misleading, defamatory, offensive, or otherwise in breach of these Terms.
6.2 The prize is not transferable or exchangeable and may not be deferred.   
6.3 To the fullest extent permitted by law, the Organisers will not be held liable for any loss or damage incurred by participants in connection with the Competition or acceptance of any prize.

6.4 The Competition is not in any way sponsored, endorsed, administered by, or associated with any social media platform.
